Monthly Subscription Fee: Our core website platform service is billed on a monthly subscription basis at $49 per month (unless explicitly stated otherwise in a separate written agreement).
Billing Cycle: Subscriptions are billed automatically on a recurring monthly basis to the payment method provided at checkout.
No Hidden Fees: Your monthly subscription fee covers website hosting, platform usage, basic maintenance, and customer support as specified in your plan.

3. Domain Names
Client Responsibility: Domain name registration and renewal fees (e.g., yourbusiness.com) are not included in the $49/month subscription fee unless explicitly provided in a special promotion.
Ownership: You maintain full ownership of your domain name. You are responsible for maintaining active registration and DNS settings, though our team will assist you with the technical setup to point your domain to our platform.
4. Proprietary Platform and Intellectual Property
Client Content: You retain full ownership of all text, logos, trademarks, images, and other materials provided by you to be published on your website (“Client Content”). You grant UP! a non-exclusive, worldwide license to display and host your content solely for the purpose of delivering the Services.
Platform Ownership: The underlying software, design frameworks, source code, visual design elements, platform infrastructure, and CMS tools remain the exclusive intellectual property of UP! Creative Marketing.
License Grant: Your monthly subscription grants you a non-transferable, non-exclusive license to use our platform and display your website while your account is active and paid in full. If your subscription is canceled or terminated, access to the platform and the hosted website will end.
5. Client Responsibilities & Acceptable Use
You agree to provide accurate business information and necessary content (logos, text, photos) in a timely manner. You also agree not to use our platform or Services to:
● Host or transmit illegal, fraudulent, defamatory, or harmful content.● Violate any applicable federal, state, or local laws or regulations.● Distribute viruses, malware, or any other malicious code.● Infringe upon the copyright, trademark, or intellectual property rights of third parties.
6. Service Availability & Maintenance
We strive to ensure maximum website uptime and platform availability. However, temporary downtime may occur due to scheduled maintenance, software updates, or unexpected server/network outages. UP! is not liable for any lost revenue or business interruption resulting from temporary website downtime.
7. Limitation of Liability
To the maximum extent permitted by applicable law, UP! Creative Marketing, its directors, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of revenue, profits, data, or goodwill) arising out of or related to your use of our Services or platform.
